The Commonwealth Secretariat Arbitral Tribunal is the body that deals with disputes involving the Commonwealth Secretariat. It has the power to determine applications brought by members of staff of the Commonwealth Secretariat; the Commonwealth Secretariat itself; or other persons who enter into contracts with the Commonwealth Secretariat, which allege the non-observance of contracts in writing with the Secretariat. Additionally the CSAT is also competent to hear and determine similar types of applications, involving international or intergovernmental Commonwealth bodies or organisations that meet the requirements set out in the CSAT Statute.
The remedies the CSAT may order include the rescission of the decision contested or the specific performance of the obligation invoked, or in addition to, or alternatively to any such remedy, appropriate compensation for any loss or damage occasioned.
After the review process outlined in the Statute is exhausted, the judgment of the Tribunal is final and not subject to appeal.
The eight Tribunal members are distinguished jurists or legal practitioners selected from across the five regions of the Commonwealth.
